Event Terms & Conditions

Home		By registering for the National Auto Auction Association, Inc’s (“NAAA”) World Automobile Auctioneers Championship (the “Event”), you as the participant, contestant, volunteer, exhibitor, sponsor, spectator, or attendee (individually or collectively, “you”) agree to the following terms and conditions (the “Agreement”). 1. Event Admission and Privacy Policy   1.1. Your registration entitles you to one admission to the Event.   1.2. You will comply with all rules and guidance published prior to or during the Event, whether in writing or by announcement whether by NAAA or the venue hosting the event. NAAA or the host venue reserves the right, in its sole discretion, to expel you from the Event if your behavior or conduct creates a disruption, violates the rules and/or guidance, or otherwise affects the enjoyment or safety of other attendees.   1.3. NAAA may, in its sole discretion, change any and all aspects of the Event with no prior notice to you, including but not limited to, the Event name, themes, content, program, schedule (date and time), participants, and venue.   1.4. NAAA does not share personal identifying information about you to any external third party except as otherwise stated in this Agreement. The information gathered will include, but is not limited to, (i) information voluntarily supplied by you when you register for the Event; and (ii) additional information that may be collected as you participate in the Event and navigate the NAAA website. Once you provide personal identifying information, it will only be used for purposes as stated in this Agreement and at the NAAA Privacy Policy (https://www.naaa.com/Privacy_Policy/NAAA_Privacy_Policy.html). Such information will not be transferred to other parties unless otherwise stated in this Agreement or at the point of data collection. NAAA reserves the right to disclose any information as required by law, a court order, or to a duly authorized investigative agency. 2. Media     NAAA and the host venue may record, film, photograph, or capture your likeness at the Event. You acknowledge and agree that NAAA has full right, title, and interest, in all recordings, film, photographs, or likenesses of you from the Event (collectively, the “Media”), and may, in its sole discretion, distribute, broadcast, livestream, or otherwise globally disseminate, in perpetuity, such Media without any further approval from you and without any obligation to pay you. You further acknowledge and agree that NAAA’s rights include, but are not limited to, the right to edit such Media, the right to use the Media alone or together with other information, and the right to allow third parties to use and/or disseminate the Media. 3. Fees     You will pay the applicable Fee for the Event upon registration, including any applicable sales tax, value added tax or duties, and administrative and/or processing fees (collectively, the “Payment”). If such Payment is insufficient or declined for any reason, NAAA and the Event may refuse to admit you to the Event. 4. Cancellation and/or Substitution     If you cancel your registration or attendance on or before March 15, 2024, you will receive a full refund of the amount of your Fee. If you cancel after March 15th, 2024, you will not be eligible for a refund under any circumstances; however, substitutions (subject to availability) may be arranged at the sole discretion of NAAA and the Event. 5. Prize for Participant Auctioneers and Ringpersons   5.1. NAAA and the Event hired a third-party entity to conduct scoring for all aspects of competition at the Event and to determine award of any prize to a participant, contestant auctioneers or ringpersons (the “Competition Vendor”). NAAA shall provide registration information for participant or contestant auctioneers or ringpersons to the Competition Vendor.   5.2. Any and all instructions or rules (including challenge or appeal of scoring) for the auctioneer, ringperson or teams competition shall be supplied by the Competition Vendor, and you agree to comply with the Competition Vendor instructions and rules. Under no circumstance shall NAAA and the Event have any liability for the Competition Vendor activities and services, including but not limited to, scoring processes, determination of prizes and awards, distribution or delivery of prizes and awards. NAAA and the Event shall have no obligation to attend to, manage, withhold and pay to any governmental entity, any tax or fee associated with award of any prize, tangible or intangible, to you. You are solely responsible for reporting and payment of any local, state, or federal tax or fee applicable to any prize or award.   5.3. Acceptance of any and all prizes or awards constitutes permission for NAAA and the Event to use your name, likeness, and other Media for purposes of advertising, trade, and commerce without further approval or permission from you or compensation to you.   5.4. NAAA and the Event are not responsible for any loss, liability, or damage arising of any participant or contestant acceptance of, use, misuse, or failure to use, any price or element thereof. Returned, undelivered, unclaimed, or un-awarded prizes, or any element thereof, will not be reawarded by NAAA and the Event. The award or prize is non-transferable.   5.5. Refer to the Event website and registration materials for a description of the prizes and awards (https://www.autochampionship.com). 6. Intellectual Privacy   6.1. All intellectual property rights in and to the Event, the Event content and all materials distributed at or in connection with the Event are owned by NAAA. You may not use or reproduce, or allow anyone to use or reproduce, any trademarks or other trade names appearing at the Event, in any Event content and/or in any materials distributed at or in connection with the Event, for any reason without the prior written permission of NAAA.   6.2. Nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trademarks or other intellectual property rights owned or used under license by, all of which shall at all times remain the exclusive property of NAAA and/or the Event. 7. Intellectual Privacy   7.1. NAAA and the Event give no warranties in any aspect concerning the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to, warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither NAAA nor the Event accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.   7.2. You are fully aware and acknowledge that whether you attend or participate in the Event as a contestant, employee, volunteer, exhibitor, sponsor, or spectator, the Event includes moving automobiles and portions of the Event venue are open to the weather, and thus the Event is dangerous and presents the potential for substantial and serious risks that could result in injury or death and the loss of, damage to, or destruction of, your personal property. By registering for the Event, you fully acknowledge, accept, and assume all risks associated with attendance at and/or participation in the Event, whether risks are apparent, known, unknown, unforeseen, present or contingent, and whether or not caused by any negligence of NAAA and the Event, or the negligence of any contestant, employee, volunteer, exhibitor, sponsor, or spectator, including, but not limited to, any aspect of the design, staging, supervision, maintenance, presentation, conduct, or sponsorship of the Event.   7.3. You hereby expressly and completely waive, release, discharge, hold harmless and otherwise agree not to sue, NAAA or any of its officers, directors, employees, volunteers, agents, successors, or assigns, or the Event, in any manner for any claim, loss, or damage, through any forum, at common law or under any statute, rule, regulation, or other mechanism of law.   7.4. Other than to the extent required as a matter of law, neither NAAA, or any of its officers, directors, employees, volunteers, agents, successors, or assigns, nor the Event, shall be liable for any direct, indirect, special, incidental, or consequential costs, attorneys’ fees, damages or losses arising, directly or indirectly, from the Event or other aspect related thereto or in connection with this Agreement or the Event.   7.5. The maximum aggregate liability of NAAA and the Event for any claim in any way connected with this Agreement or the Event, whether in contract, tort, or otherwise (including any negligent act or omission), shall be limited to the Fee paid by you to the Event under this Agreement to attend or participate in the Event. 8. Governing Law and Jurisdiction     This Agreement shall be governed by the laws of the State of Maryland and the parties shall submit to the exclusive jurisdiction of the courts in Frederick County Maryland.
